Hector Quiroga explained this process in depth, noting, “Typically, it’s about somebody has to petition for you… So if you have somebody who’s immediate relative… it’s a spouse, you go through a husband wife, they are citizens. That’s a family case.”

Immediate family members such as parents, children under 21, and spouses can often fast-track their immigration status. Quiroga further elucidated that the immigration system sharply distinguishes between immediate and non-immediate family members, the latter suffering longer waits. “For instance, petitioning for a sibling can take many years, and in certain countries like Mexico, it can take up to 22 years,” he added.

The system clearly prefers immediate family relationships, likely for reasons such as maintaining strong family units and ensuring swift integration into U.S. society. This prioritization, however, leaves extended family members in a difficult and often lengthy limbo, illustrating a significant flaw in the current system.

Employment and Investment Visas

The U.S. provides avenues for skilled and unskilled workers through employment and investment visas. These visas, often known as H visas, allow employers to bring in foreign labor for jobs that domestic labor markets cannot supply. Quiroga noted, “The employer has to show that they tried to interview, they tried to get this labor here in the U.S. They didn’t. So, if they don’t, then they have to do what is called… labor certification.”

Under this system, employers must ensure they are not underpaying immigrant workers to exploit cheaper labor. This safeguard helps protect the wages and job conditions of all workers but it also complicates the process for employers and potential employees alike.

One fascinating aspect discussed was the investment visas, where individuals can gain entry by contributing significant financial resources to the U.S. economy. “If you can invest more than certain amount of money, in some cases is half a million or a million dollars that you can actually show cash that you’re going to invest,” Hector explained.

These avenues provide critical skills and capital to the U.S. economy but require navigating a complicated and often arduous process to prove the necessity and suitability of hiring foreign talent or accepting foreign investment.
